Terms of Use

Welcome to Here & There, an online internet platform that offers to Civil Society Organizations, research institutes, governmental organizations and individuals in-between those actors the possibility of creating a web space where they can make their knowledge available and exchange it with different performers in a self-customized environment.

Here & There is operated by the Stichting Internationalist Review. By using or accessing this web platform, you agree that you have read, understand and are bound by these Terms of Use. We reserve the right, at our sole discretion, to change or delete portions of these Terms at any time without further notice. Your continued use of Here & There after any such changes constitutes your acceptance of the new terms.

General Terms

THE USE OF HERE & THERE IS AT YOUR OWN RISK. ITS SERVICES AND ALL APPLICATIONS, FEATURES, CONTENT AND MATERIALS MADE AVAILABLE ON, IN CONJUNCTION WITH OR THROUGH HERE & THERE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT HERE & THERE SERVICE WILL BE AVAILABLE, UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED OR THAT OUR SERVICE OR THE SERVER THAT MAKES IT AVAILABLE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, WILL HERE & THERE OR ITS PARTNERS BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, RELIANCE OR EXEMPLARY DAMAGES, INCLUDING FOR ANY LOST PROFITS OR LOST DATA, THAT RESULT FROM YOUR USE OR YOUR INABILITY TO USE OUR SERVICES, FEATURES OR CONTENT MADE AVAILABLE ON, IN CONJUNCTION WITH OR THROUGH HERE & THERE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN SUCH CASES, HERE & THERE'S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

IN NO EVENT WILL THE TOTAL AGGREGATE LIABILITY TO YOU OF STICHTING INTERNATIONALIST REVIEW OR ITS PARTNERS FOR ALL DAMAGES, LOSSES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF HERE AND THERE, INCLUDING WITHOUT LIMITATION YOUR INTERACTIONS WITH OTHER USERS OF HERE & THERE (WHETHER IN CONTRACT, TORT INCLUDING NEGLIGENCE, WARRANTY OR OTHERWISE).

Suspension or Discontinuation of the Service

We reserve the right at any time to suspend or discontinue Here & There (or any part thereof) with or without notice to you. You agree that neither Stichting Internationalist Review nor any of its partner institutions shall be liable to you or to any third party for any suspension or discontinuation of the Service.

Registration

When you register for and use Here & There, you agree to have read, understood and accepted this terms of use.

All users must be 18 or over to sign up for an account on Here & There. You must register as a Here & There member prior to creating or editing certain contents on the website. You can set up an account by designating a username and password and providing some additional required information, including your email address. You are solely responsible for maintaining the confidentiality of your password and for all activities that occur under your Here & There account.

Use of your Here & There account is strictly limited to your own personal use. You agree to immediately notify Here & There administrator of any unauthorized use of your Here & There account or any other breach of security.

What is prohibited in Here & There?

By using or accessing Here & There, you represent, warrant and agree that you will not:

Post anything that harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability;
do anything that could disable, overburden or impair the proper working of Here & There Service;
use any robot, spider, scraper or other automated means to access Here & There;
send spam or any other unauthorized advertisements or solicitations through or using Here & There;
post unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, promotes or encourages illegal activity or is harmful to minors in any way;
collect personal data about other users for commercial or unlawful purposes;
harvest, collect or use addresses, phone numbers or email addresses or other contact information of users of Here & There without consent from such users;
make available information that is pornographic or depicts sexual conduct;
post information that advertises any illegal service or the sale of any items the sale of which is prohibited or restricted by any applicable law, including without limitation items the sale of which is prohibited or regulated by Belgium law;
remove any copyright, trademark or other proprietary rights notices contained on the Website or within Here & There;
use the Service to violate the security of any computer network, crack passwords or security encryption codes, transfer or store illegal material including that are deemed threatening or obscene;
post anything that is objectionable or which restricts or inhibits any other person from using or enjoying the site, or which may expose Stichting Internationalist Review employees or our partners’ employees or any users to any harm or liability of any type;
post any material that contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer or telecommunications equipment;
use Here & There, intentionally or unintentionally, to violate any applicable local, state, national or international law;
post anything that that violates federal, state or local equal employment opportunity laws, including but not limited to, stating in any posting for employment a preference or requirement based on race, color, religion, sex, national origin, age or disability;
reformat or frame any portion of the web pages that are part of the Website and/or Service;
create user accounts by automated means or under false or fraudulent pretenses.

User content

User content means any photos, text, link, audio, video, designs, ads and anything else that you upload, post, transmit, share, store, link to or otherwise make available on or through Here & There.

Here & There does not pre-screen, review, edit or approve any User Content. The website administrator can, in its sole discretion, remove or disable access to any user content.

Content Ownership

We claim no intellectual property rights over the material you provide to Here and There. Your profile and materials uploaded remain yours. However, by setting your pages to be viewed publicly, you agree to allow others to view your content. By setting your repositories to be viewed publicly, you agree to allow others to view and fork your repositories.

Furthermore, by posting or otherwise making available any content on the Service, you agree to and hereby do grant, and you represent and warrant that you have the right to grant, Stichiting Internationalist Review an irrevocable, perpetual, non-exclusive, royalty-free, fully sublicensable, fully paid up, worldwide license to use and copy of such content, as far as your property rights on those content remain untouched and protected.

Intellectual Property Complaints

We respect the IP rights of others and we prohibit users from posting any content that violates another party's IP rights. When we receive a proper claim of IP infringement, we promptly remove or disable access to the allegedly infringing user content. We also terminate the accounts of repeat infringers in appropriate circumstances. If you believe that any content on Here & There infringes your IP rights, please contact us. If you are a user whose content was removed due to alleged copyright infringement, and you believe the removal was mistaken, please contact us as well.

Ownership

Except for the users’ content, all content and logos on Here & There are the property of Stichting Internationalist Review, except the logos of our partners, which are indicated as so. Except as expressly authorized by the Stichiting Internationalist Review in writing, you agree not to use, sell, license, distribute, copy, publish, stream, publicly perform or display, transmit, reformat, modify, edit, frame, translate, excerpt, adapt, create derivative works or otherwise make unauthorized use of Here & There content or logos.
